Please read these Terms of Service carefully before using Hanmela. These terms govern your use of our marketplace platform connecting Korean and Indian buyers and sellers.
1. Acceptance of Terms
By creating an account or using Hanmela, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms form a binding contract between you and Hanmela (operated by Blue Ridge Trade LLP and Kindra Global).
2. Eligibility
You must be at least 18 years old to use Hanmela. By registering, you confirm you are legally capable of entering into contracts. Sellers must have valid business credentials in their country of operation.
3. Buyer Responsibilities
Buyers are responsible for providing accurate shipping information. Orders placed are binding commitments to purchase. Buyers may not misrepresent identities, abuse the returns process, or engage in chargebacks without first following our dispute resolution process.
4. Seller Responsibilities
Sellers must list only genuine products that they have the right to sell. Product descriptions, images, and pricing must be accurate. Sellers must fulfil orders within their stated processing time. Sellers are solely responsible for customs compliance, duties declarations, and taxes applicable to their transactions.
5. Prohibited Items
The following are strictly prohibited on Hanmela: counterfeit goods, stolen property, weapons, hazardous materials, illegal substances, adult content, items that infringe intellectual property rights, and any item illegal in India or South Korea. Violation results in immediate account termination and may be reported to law enforcement.
6. Payments and Fees
Buyers pay the listed price plus applicable shipping at checkout. Hanmela charges sellers a percentage commission on each completed transaction. Platform fees are displayed during seller onboarding and may be updated with 30 days' notice. Payments are processed by Razorpay; Hanmela does not handle or store card details.
7. Escrow and Payouts
Buyer payments are held in escrow until delivery is confirmed. Seller payouts are released after the delivery confirmation window, minus the platform commission. Hanmela reserves the right to withhold payouts during active disputes or fraud investigations.
8. Returns and Disputes
Our returns and dispute policy is described in full at hanmela.com/returns. Buyers have 7 days from confirmed delivery to raise eligible return requests or disputes. Hanmela acts as a neutral mediator; our decisions on disputes are final.
9. Intellectual Property
Hanmela owns all rights to the platform, logo, brand assets, and proprietary technology. Sellers grant Hanmela a non-exclusive, royalty-free licence to display product images and descriptions on the platform for the purpose of facilitating sales.
10. Limitation of Liability
Hanmela provides the marketplace platform but is not party to transactions between buyers and sellers. To the maximum extent permitted by law, Hanmela is not liable for: product quality, seller conduct, shipping delays, customs issues, or any indirect, incidental, or consequential damages. Our aggregate liability to any user shall not exceed the total fees paid to Hanmela in the 12 months preceding the claim.
11. Account Termination
Hanmela may suspend or terminate accounts that violate these terms, engage in fraud, or receive repeated verified complaints. Users may close their accounts at any time from account settings. Obligations incurred before termination (outstanding orders, disputes) survive termination.
12. Governing Law
These terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India. For users in South Korea, Korean consumer protection laws may additionally apply.
13. Changes to Terms
We may update these terms at any time. Material changes will be communicated by email with 14 days' notice. Continued use of Hanmela after the notice period constitutes acceptance of the updated terms.
